Someone has the name i want and is not active since 9 months, Can I take that name?

You are going to have to ask the support to change the Name for you, and that usually depends on a few factors.

I'd imagine they check for the time they last logged on and their rank.

In case a player is inactive with an IGN you would like to use, you still need to contact the support team to free the IGN. The support team will investigate if the player is inactive long enough and his level, to ensure that we can make the requested IGN available.

However, you need to wait 90 Days to be able to use it again when it gets freed up, so patience is of utmost importance.

You probably won't be able to take the name. I've been waiting on one that has been inactive for over 10 months now and they still won't give it to me, and I know a few other people that have been waiting for names that have been inactive for even longer.

The name i want is just a pfc account with 3 games i really hope i get it. hope you get the name you are waiting for too.

Well then your case is different from my own. I'm attempting to take the name of someone who actually used to play the game. You'll probably have more luck than me :P
