If someone is the last red rank (max) and goes inactive, does he go back to 5 star?

Eventually, yes, because other players go up while he goes inactive and so the rank ratio changes.

If you are the last guy who achieved marshal 3 you can derank to 5 stars as soon as someone pass the rep amount you have. If by max you mean marshal 1 then you will have to wait few years till last guy with marshal 3 get the rep of current last guy with marshal 1 or your rep:P
