2) he didn't have a gun to his head he was ASKED if he wanted to give up his account, if he replied NO then no-one was about to pull a trigger ....

The guy pointing a gun can pull the trigger, you are in serious threat.

The guy asking a question, you can simply refuse to answer and walk away.
