They can sue them, hacks require an injection of data into their original source editing their data breaches the data protection act.
The main reason it's so hard to sue them is the terms of service on their websites it claims nobody who owns any of a certain website or is an employee of a specific company (all of the websites and companies they create hacks for) are aloud to access their website and any evidence they could get would be illegal for them to obtain.
