You should report anybody you encounter in which he or she is cheating or violating the ToS.

To stop lag spikes. I highly recommend a new ISP.

About your lag spikes; you should always play on the server that's closest to your country, equals less lag. If you got vista, there's a bug going around that sends your ping sky rocketing, I think there's a solution for that, not sure. Search the forums, you'll be able to find it.
